    Well none of us can know for sure. However he has stabbed/killed someone and needs to justify his actions. Racially aggravated assault is a more serious crime than non-racially aggravated assault so it makes sense that he would pick the racial crime to bolster his defence.

    Absolutely, and Henry Nowak's father was very clear about that in his comments. There are questions for the police to answer as to how they reacted to a motionless man on the ground telling them he couldn't breathe and had been stabbed, but they did not murder him.
